Before you sign
3 to 6 months' rent is commonly asked in Mumbai.
Checking a office
- Ask whether rent is on carpet area or super built-up area; super built-up can be 30% more than the space you use.
- Ask about power backup: how much load, for how many hours, and what it costs a month.
- Ask for the building's occupancy certificate (OC); without it, the office can be sealed.
- Check lifts, parking, security hours and which internet providers already reach the building.
- The deposit
- Shops and offices ask far more than a flat: often 3 to 12 months' rent. Agree in writing what can be cut from it when you leave: putting the space back to a bare shell, unpaid maintenance, the last bills. Those are the usual fights.
- Lock-in
- 12 to 36 months is common. Ask whether it binds the owner too, and what you pay if you leave early.
- Rent increases
- Usually about 5% a year, or 15% every three years. Get the schedule into the agreement.
- Maintenance (CAM)
- Malls and complexes charge maintenance per square foot on top of the rent, and often the power backup too. Ask for last year's bills before you sign.
- GST
- If the owner is GST-registered, 18% GST is added to the rent. If you're registered and the owner isn't, you may have to pay it yourself under reverse charge. Ask your accountant.
- Registration
- Agreements of 11 months or less are often only notarised; a longer lease is normally registered. Ask who pays the stamp duty.
